Welcome to Sharklish. By accessing or using our platform, website, or services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use Sharklish.
1. Description of Service
Sharklish is an AI-powered platform that enables users to:
- Generate videos and music using AI
- Add text overlays to videos
- Connect social media accounts, including Instagram, Facebook, and YouTube
- Publish and schedule content on their own social media accounts
2. User Responsibilities
By using Sharklish, you agree that:
- You will use the service only for lawful purposes
- You will not upload, generate, publish, or distribute content that violates any applicable laws, regulations, or third-party rights
- You are fully responsible for all content you create, edit, upload, schedule, or publish through Sharklish
- You will not attempt to misuse, disrupt, exploit, reverse engineer, or gain unauthorized access to the platform or its systems
3. Account and Access
- You are responsible for maintaining the confidentiality of your account and login credentials
- You are responsible for all activities that occur under your account
- You must provide accurate, current, and complete information when using Sharklish
- We reserve the right to suspend or restrict access to accounts that violate these Terms or create risk for the platform or other users
4. Social Media Integration
Sharklish allows users to connect third-party platforms such as Instagram, Facebook, and YouTube. By connecting your accounts:
- You authorize Sharklish to publish or schedule content on your behalf
- Actions are performed only when explicitly initiated, approved, or scheduled by you
- You may disconnect your accounts at any time
Sharklish does NOT automatically publish content without explicit user action, approval, consent, or scheduling instructions.
Sharklish is NOT responsible for:
- Changes made by third-party platforms or APIs
- Platform outages, access restrictions, suspensions, or API limitations
- Delays or failures caused by third-party platforms
5. Content Ownership
- You retain ownership of the content you create, upload, or generate through Sharklish
- You grant Sharklish a limited, non-exclusive license to process, store, display, and deliver your content solely for the purpose of operating and providing the service
- You are solely responsible for ensuring that your content does not infringe any copyright, trademark, privacy, publicity, or other third-party rights
Users are fully responsible for the content they publish through Sharklish. Sharklish acts only as a tool and service provider and does not assume responsibility for user-generated content or for user actions performed on third-party platforms.
6. AI-Generated Content
Sharklish uses artificial intelligence to generate videos, music, captions, text overlays, and related content. By using AI-generated outputs from Sharklish, you understand and agree that:
- We do not guarantee originality, uniqueness, accuracy, legality, or fitness for a particular purpose
- AI-generated content may contain errors, inconsistencies, or similarities to other content
- You are responsible for reviewing, editing, approving, and verifying generated content before publishing or using it
- You assume full responsibility for how the content is used
7. Payments
- Sharklish operates on a one-time payment model unless otherwise stated
- All payments are final unless a different refund policy is explicitly provided at the time of purchase
- We do not store payment card details
- Payments are processed through third-party payment providers, which may have their own terms and policies
8. Prohibited Use
You agree not to use Sharklish to:
- Engage in illegal, harmful, deceptive, fraudulent, or abusive activities
- Upload or distribute malicious code, malware, spam, or harmful content
- Violate the rights of others, including intellectual property rights
- Attempt unauthorized access to the platform, accounts, servers, APIs, or connected services
- Violate the policies, terms, or rules of third-party platforms, including Instagram, Facebook, and YouTube
- Publish content without having the rights or authorization to do so
9. Termination
We reserve the right to suspend, restrict, or terminate your access to Sharklish at our discretion if:
- You violate these Terms
- Your use creates legal, security, or operational risk
- Your content violates applicable laws or third-party platform policies
We may also remove or restrict access to content that violates these Terms, applicable law, or third-party platform requirements.
10. Limitation of Liability
Sharklish is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, Sharklish shall not be liable for:
- Loss of data, media, content, revenue, profits, or business opportunities
- Errors, omissions, delays, or failures in AI-generated content
- Publishing failures, scheduling delays, or platform-related issues
- Actions, restrictions, suspensions, or decisions made by third-party platforms
- Any indirect, incidental, consequential, special, or punitive damages
11. Third-Party Services
Sharklish integrates with third-party services and platforms, including:
- Instagram (Meta)
- Facebook (Meta)
- YouTube (Google)
Your use of those services is subject to their own terms, policies, and platform rules. Users agree to comply with the terms and policies of third-party platforms, including Meta and Google, when using Sharklish.
12. Changes to These Terms
We may update these Terms of Service from time to time. Any updates will be posted on this page. Your continued use of Sharklish after changes become effective constitutes your acceptance of the updated Terms.
